Terms of Service — Testing Phase

By creating an account and ticking the box, you agree to these terms.

A staff scheduling tool for bars and restaurants, in an early, free testing phase. Features may change, break or be removed. Nothing is charged during testing. If paid plans come later, nothing will be charged without your clear agreement first.

• Accounts are for people aged 18 and over.
• A venue account is opened by the venue owner or someone allowed to act for the venue. That person accepts these terms for the venue.
• Team members who join through an invite accept these terms for their own use of the app.

• The venue is the employer and is responsible for the data it enters about its team, including having a legal basis for it and telling its team that Teemfix is used.
• Enter only what is needed. Do not write medical details in notes.
• Team members under 18 may only be added without an email.
• Share invite links and public schedule links only with the right people. Anyone holding an invite link can claim that profile, and anyone with a public link can see that week's schedule.
• Check schedules, overtime and tip amounts before relying on them or paying. Teemfix is a planning aid. It is not an official working-time record and does not replace the records or filings the law requires from employers.

Use Teemfix only to schedule and manage your own venue's team. Do not try to access other venues' data, test or break its security, overload the service, send spam through invites, or upload anything unlawful.

For the data a venue enters about its team, I act on the venue's behalf:

• I use it only to provide Teemfix as the venue uses it, and for nothing else.
• I keep it confidential and protect it as described in the privacy policy.
• I use the service providers listed in the privacy policy. New providers will be announced in advance; a venue that disagrees can stop using Teemfix.
• I help the venue answer requests from its team members about their data.
• I tell the venue without undue delay if a data breach affects its data.
• When a venue stops using Teemfix (it asks, or no admin has logged in for 12 months and a warning email got no response), its data is deleted within 30 days. Backups expire about 14 days after that.
• On request, I give the venue the information it needs to check these commitments.

Teemfix is provided as it is during testing. I do my best, but I cannot promise that it is always available, free of errors, or that data is kept forever. Data may occasionally need to be reset; notice will be given where practical. Keep your own copy of anything you are required to keep.

As far as the law allows, I am not liable for loss or damage from using Teemfix, including scheduling errors, wrong tip or overtime amounts, lost data or downtime. This does not limit liability for intent or gross negligence, or any liability that cannot be excluded by law.

If someone makes a claim against me because a venue entered data unlawfully or used Teemfix against these terms, the venue covers the resulting costs.

• You can stop using Teemfix and ask for your data to be deleted at any time: contact@teemfix.com
• I may suspend or close an account that breaks these terms, or end the testing phase, with notice where practical.
• When use ends, data is deleted as described in section 6 and the privacy policy.

These terms may change as Teemfix develops. Major changes will be announced in the app before they apply. If you keep using Teemfix after that, the new terms apply.

Swiss law applies. Disputes are decided by the courts at my place of residence in Switzerland. If you use Teemfix as a consumer, the mandatory protections of the country where you live still apply.
